Plevin & Gallucci Plays Key Role in National Opioids Litigation
Plevin & Gallucci represented the two Ohio county governments in the bellwether opioids trials recently held in Cleveland. The litigation has resulted in over $40 billion in settlements and an additional verdict of $650.6 million for the two Ohio counties.
Managing partner Frank L. Gallucci III was co-lead counsel for three bellwether plaintiffs, one that helped drive the initial $26 billion in settlements and two others that, in addition to yielding a verdict against CVS, Walgreens and Walmart, helped lead to just under $14 billion in national settlements with the same three defendants. This is the nation’s first trial attempting to hold pharmacies responsible for their role in the opioid crisis that has resulted in thousands of deaths and an addiction crisis that has heavily impacted Ohio.
Frank has frequently appeared in national media to discuss the opioid epidemic and national litigation. Watch this space for regular updates.

Experienced Workers’ Compensation Lawyers in Ohio
What If My Workers’ Compensation Claim Is Denied?
If your Ohio workers’ compensation claim is denied, don’t lose hope. Oftentimes claims are denied with the hope that the injured worker will not seek the necessary assistance to protect his or her rights. The first step is to carefully review the denial letter to understand the reasons for the decision. It’s important to act quickly, as you have a limited time to appeal the decision—typically within 14 calendar days of receiving the denial notice.
Consider consulting with a workers’ compensation lawyer who can guide you through the appeals process. Your lawyer can assist in gathering additional evidence, such as medical records or expert testimony, that supports your claim. Together, you can file an appeal with the Ohio Industrial Commission, where your case may be reviewed in a hearing. Successfully appealing a denied claim is challenging, but with the right preparation and support, you can increase your chances of obtaining the benefits you deserve.
Can I Be Fired for Claiming Workers’ Compensation in Ohio?
In Ohio, it is illegal for an employer to fire you solely because you filed a workers’ compensation claim. This protection is in place to ensure that employees can seek compensation for work-related injuries or illnesses without fear of retaliation. If you believe you have been fired, demoted, or faced any adverse action because of your claim, you might have grounds for a wrongful termination or retaliation lawsuit.
If you find yourself in this situation, Plevin & Gallucci can help you protect your rights and possibly pursue legal action against your employer. Remember that the law is designed to protect workers who are injured on the job, ensuring they receive the support they need without jeopardizing their employment.
Dedicated Personal Injury Attorneys
If you’ve been injured in a car accident, the path to recovery can seem impossible at times. We’ll fight to get you the compensation you deserve. Our experience in handling car accident claims means that we’re adept at dealing with defendants, insurance companies, and their counsel. Your interests are always put first and we strive for the maximum compensation available.
How Long You Have to File a Personal Injury Claim in Ohio
In Ohio, you generally have two years from the date of your injury to file a personal injury lawsuit. This time limit, known as the statute of limitations, is important for ensuring your case is considered by the court. It’s important to be aware of this deadline because if you try to file a lawsuit after this period has expired, your case is likely to be dismissed, and you will lose the opportunity to seek compensation for your injuries.
However, there are exceptions that might extend this deadline under certain circumstances. Examples include an underage victim or delayed discovery of your injuries. Given the importance of this timeframe, it’s advisable to consult with a personal injury lawyer as soon as possible after your injury to make sure your rights are fully protected.
What You Should Do Immediately After an Accident
Your top priority following an accident should be safety and health. If you or anyone else is injured, call 911 right away to get medical help. Even if injuries seem minor, it’s important to see a doctor, as some injuries can take time to show symptoms.
Next, if it’s safe to do so, gather evidence by taking photos of the accident scene, your injuries, and any damage to your property. Try to get contact information from any witnesses and the other parties involved in the accident. It’s also a good idea to write down what happened while it’s fresh in your mind. With some accident types, you may have to notify your insurance company but be cautious about providing detailed statements or accepting settlements without consulting a lawyer.
Lastly, consider speaking with a personal injury lawyer to understand options for seeking compensation for your injuries and losses. Your lawyer can determine if you need to take immediate action to protect yourself and your family by demanding that the potentially responsible parties take the necessary steps to preserve all relevant evidence. This step can be the difference between whether or not your case succeeds. Additionally, your lawyer can evaluate your claim, gather evidence, and negotiate or litigate for the compensation you deserve.
What Fees Do Personal Injury Lawyers Charge?
Personal injury lawyers in Ohio typically work on a contingency fee basis. This means that they do not charge anything upfront. Instead, their payment comes as a percentage of the compensation you receive if you win your case or reach a settlement. It’s important to discuss and understand the fee structure during your initial consultation with a lawyer.
Additionally, some lawyers might also cover expenses related to your case (like filing fees, costs of gathering records, and expert witness fees) up front, which are then reimbursed from the settlement or award. Always make sure these terms are clearly outlined in your agreement so you know what to expect in terms of financial obligations.
